Booking Terms and Conditions
GUEST TERMS & CONDITIONS OF BOOKING
To protect all parties involved in the letting of Huon Creek Retreat we ask that you carefully read the following terms and conditions:
LICENCE TO OCCUPY
The Owner is the registered owner of the Accommodation. The guest is authorised to occupy the Accommodation during the agreed period as set out in the Booking Summary. The guest is not a tenant of the Accommodation and has not been granted exclusive possession of the Accommodation.
The farm buildings and land are not part of the agreement, guests are welcome to wander and enjoy the property, this is at their own risk and Huon Creek Retreat accepts no liability. Please note there are stock water troughs and a seasonal creek running through the entire property located approx. 100m from the home. Guests will need to be vigilant with children.
Huon Creek Retreat is situated on a working farm with livestock and a business; therefore, people may need to occasionally attend the workshop or livestock during business hours. We will always minimize any disruption to your peaceful stay not being near home unless unavoidable.
For your safety the workshop as well as bore area cannot be accessed by guests. For both guest and property security the workshop, driveways and home surrounds are monitored by CCTV. All visible and for privacy only reviewed if deemed necessary.
BOOKING TERMS AND CANCELLATIONS
Bookings can be made online, they are confirmed when we receive the Registration Form, these Terms and payment via bank transfer or credit card. Payment via bank deposit is required within 24 hours of making the booking.
Upon receipt of payment we will send an email confirmation and booking summary subject to these terms.
If you have booked through an Agent website, the payment requirements of the platform will apply to your booking.
Cancellation Policy: We understand that at times your plans will change and we will endeavour to fill your booking and provide you the maximum refund. If you need to cancel or amend your booking, please notify us as soon as possible in writing.
- A full will be provided with more than thirty (30) days’ notice prior to check in date.
- 50% of all accommodation charges will be incurred if you cancel with less than fourteen (14) days’ notice.
- 100% of all accommodation charges will be incurred if you cancel with less than 48 hrs notice.
Cancellations and Amendments
The Owner reserves the right to cancel a booking at any given stage issuing a full refund to the Guest. If this does happen, we will contact you as soon as possible. We will not be liable to refund you for any fees you may have paid to any third party in connection with your holiday (including, without limitation, fees for travel, entertainment, activities or insurance).
Huon Creek Retreat reserves the right to terminate any booking and immediately remove any Guest/s from the Property for failure to comply with the Terms of their booking, in which case there would be no refund of any monies paid and an automatic charging of the Security Bond.
SECURITY BOND
$750 refundable Security Bond is required to be paid at least 2 days prior to your arrival to cover any incidental breakages or other costs incurred because of your booking.
This Security Bond will be refunded to you within 7 days from departure of the property, pending a final inspection of the property once the guest has departed.
STAYING AT HUON CREEK RETREAT
The property will be available from 3pm on your day of arrival with a vacate time of 10am on the date of your departure. Early check and late check out available on request and subject to availability.
Any costs incurred to Huon Creek Retreat due to unauthorised overstaying by any guest will be deducted from the security bond.
Guests are responsible for safe keeping of keys. These are stored in a lockbox at front door and we suggest keeping them there for duration of stay. If keys are lost you will be responsible for costs associated with changing of barrels and new sets of keys. Should a guest require duplicate keys after hours a $150.00 service fee is applicable. Guests must not break in or attempt to break into premises when locked out.
If you become aware of anything during your stay which you believe is a health & safety risk you must inform Huon Creek Retreat immediately.
The property is let to the person making the booking (25 or older) and will be held responsible for the conduct of all guests. The premises are let for holiday or work purposes, only for the period stated on the booking summary and for the maximum persons as agreed at the time of the booking.
Huon Creek Retreat is equipped for a specific number of guests. It is against OH&S/WHS regulations for more persons to occupy a property than there are beds to accommodate them. No mattresses, tents or caravans are allowed. If it is reported to be overloaded, all guests will be asked to vacate with no refund made.
Pets are not permitted on the property. If pets are detected during your stay, you will be asked to vacate the premises. If detected after there will be a charge of $100 per pet, per night, plus $250 cleaning fee.
You must comply with the following House Rules;
- Keep and leave the Accommodation in the same condition as you find it, including outdoor area and supplied BBQ.
- All dishes and any appliances used are to be thoroughly cleaned to avoid additional cleaning fees.
- Under no circumstances are any pets or animals permitted on the property.
- Any illegal or immoral activity from the Accommodation is not permitted.
- The property is NON-SMOKING. Any smoking inside the property will incur a $250.00 fee and any extra costs associated with cleaning of the premises.
- Guest shall only park cars in areas specifically identified for Guest use, garage, and driveway. Please refrain from using grass areas.
- Furniture is not to be moved at the Property and no item from the Property is to be removed from the Premises. Only outdoor furniture is to be used outdoors.
- Guests are to ensure all bins are lined and rubbish to be placed in the bins provided.
USE OF THE PROPERTY
- Property access is only for registered guests and cars.
- Parties and Gatherings exceeding occupancy limit are strictly prohibited without prior written consent of the property owner. Please advise in writing and seek approval if you anticipate having additional guests visit the property. If you breach this condition, instant loss of bond, immediately evicted without notice and without refund or credit for any nights unused.
- Legislated noise pollution controls shall prevail at the Property and Guests are obligated to comply. No guests are to create or permit any noise or nuisance, which is likely to interfere with the peaceful enjoyment of any other neighbouring properties.
- Any complaints reported including: nuisance, annoyance, disturbance, causing damage, playing loud music, entertaining at the Accommodation will be investigated.
- All local laws must be observed. There is a firepit on the property, no other outdoor fires are to be lit and this must not be lit on total fire ban days. It is the responsibility of the guest to check the CFA website fire danger rating.
- You acknowledge that the Accommodation is located on a farm and wont access any workshop or shedding areas. You also agree not to access the storeroom in home marked private.
PROPERTY DAMAGE
The Guest acknowledges that the Security Bond shall be used for any extra cleaning, breakages, loss, damages to the Property or its surrounds, breach of the terms and conditions or any additional fees incurred as stipulated in this agreement.
You must notify Huon Creek Retreat of any damage to the Accommodation, contents fixtures or fittings which occurs during your stay, even if you regard the damage as fair wear and tear or if you do not believe the damage is your fault.
If you do not notify Huon Creek Retreat of any such damage you will be fully liable for such damage on a full replacement basis.
GENERAL
These terms and the Booking Summary represent the entire agreement between the parties and supersede any previous marketing information, representations or agreements whether recorded in writing or otherwise.
The parties agree that these terms are fair and reasonable in all the circumstances. However, if any provision of these terms is held not to be valid by a Court of competent jurisdiction but would be valid if part of the wording were deleted, then such provision shall apply with such deletions as may be necessary to make it valid. If any of the provisions in these terms are held not to be valid the remaining provisions of these terms shall remain in full force and effect.
Repairs and maintenance will be completed within business hours Monday-Friday. Unless it's deemed an emergency. We do our best to attend to all maintenance issues as and when we are notified during typical work hours.
Huon Creek Retreat has used its best endeavours to maintain the accuracy, currency and correctness of all advertising materials and information given to them with respect to the Property. Nothing in those materials shall be treated as a term or condition of this contract and details are subject to change without notice.
Huon Creek Retreat will not accept any responsibility for any matter or occurrences beyond the Manager’s reasonable control including (but not limited to) damage caused by extreme weather conditions, breakdown of appliances, wiring, plumbing, invasion of pests or noise disturbance.
CONSUMER LAW
To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Huon Creek Retreat are excluded under these Terms.
Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Huon Creek Retreat to limit its liability, then Huon Creek Retreat’s liability is limited to:
- in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
- in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
COMPLAINTS
The Guest must immediately (within 24 hours) notify Huon Creek Retreat of any complaint or problem with the Property, should there be one, and allow the Manager a reasonable amount of time to remedy the problem. The Manager must use discretion in deciding the severity and outcome of the complaint or problem. Failure to notify Huon Creek Retreat will void any claim following the booking period and vacating the Property does not constitute an adequate cause for the Guest to be refunded.
LIABILITY
No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly to any Guest or their personal belongings, baggage, vehicle and other Property whilst staying at the Property. Huon Creek Retreat accepts no responsibility for any events beyond the Manager or Owner’s control.
- The Guest acknowledges that the use of any of the Properties facilities which may result in injury, loss or damage to the Guest or their Property is the Guest’s responsibility and the Manager and Owner will not accept any liability arising there of.
- It is recommended that Guests take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during your travel period.
Failure to comply with any of the above conditions may result in immediate termination of your License to Occupy.
Huon Creek Retreat reserve the right to change the wording, add to, delete or modify these Terms from time to time.
RELEASE, INDEMNITY AND PROPORTIONATE LIABILITY
To the extent permitted by the law, you agree to release, indemnify and hold harmless, Huon Creek Retreat and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and the Owner, its agents and subcontractors (the Indemnified Parties) against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at the relevant Accommodation except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from the Indemnified Parties; negligence, wrongful act/omission or breach of these Terms.
To the extent permitted by law the aggregate of the Indemnified Parties’ liability to you is limited to an amount not exceeding the amount paid by you for your booking.
Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.
BREACH OF TERMS AND CONDITIONS
By signing these Terms, the Guest acknowledges and agrees that should it or any additional occupants or visitors breach any of the terms and conditions stated herein, you will pay to Huon Creek Retreat the total loss or damage that it suffers as a result of that breach. Further, you hereby authorise Huon Creek Retreat to debit your credit card or apply your refundable deposit in payment of that loss or damage and Huon Creek Retreat
